FMLA Update (Family and Medical Leave Act)

Employers may request medical certification of an employee’s need for leave under the Family and Medical Leave Act but it is not required. Some employers request proof of certification as a matter of course while others only do so when there are pending questions or concerns. Employers must be fair and consistent in the way they request these certifications and how the related policies are implemented. Employers may remind employees that they need to turn in the forms. Employees must be given at least 15 calendar days from the date of the employer’s initial request to provide medical certification unless the circumstances require more time.
